TRAVELOKAPAY'S TERMS AND CONDITIONS Last modified on: December 2022

THESE TERMS AND CONDITIONS MUST BE READ BEFORE USING TRAVELOKAPAY. YOUR USE OF ANY PART OF THE SITE SHALL INDICATE YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS.

When You payment using TravelokaPay on www.traveloka.com and application of Traveloka (“Site”), You acknowledge that you have read and understood, and agree to these Terms and Conditions and other Terms and Conditions in relation to the Site as referred to in these Terms, including but not limited to Traveloka's Terms and Conditions, Traveloka's Privacy Policy and FQAs which part of these Terms and Conditions. You must be at least eighteen (18) years old to use the Site.

Please note that We may change, modify, add and delete these Terms and Conditions of TravelokaPay, either in part or in whole, including any terms and regulations (as defined below) with and/or without prior notice.

You must read the Terms and Conditions of TravelokaPay periodically. By continuing to use TravelokaPay after such changes to the Terms and Conditions of TravelokaPay, visitors, User or Registered User ("You" or "User") confirm that you agree and agree to the changes. If you use any of our other services, then your use is based on compliance and acceptance of the terms and conditions applicable to those services.

By using TravelokaPay, the User must comply with the applicable laws and regulations.

Terms and Conditions of TravelokaPay is a form of a valid and binding agreement between the User and PT Traveloka Indonesia (“Traveloka”,”Us”) as the TravelokaPay service provider. If the User does not agree to the contents of theseTerms and Conditions of TravelokaPay, the User is not allowed to make payment transactions using TravelokaPay.

  1. GENERAL
    1. TravelokaPay is a payment initiation and/or acquiring service in the form of an electronic wallet created and developed by Traveloka with an official license and has obtained a category two payment service provider license from Bank Indonesia which allows You to store payment instrument data and make payments using various instrument method, from credit cards, debit cards, instant debits to electronic money on the Traveloka Site.
    2. By using TravelokaPay, the User agrees that Traveloka collects, process, uses, disclosure, and stores data that the User, including the User's personal information and/or other data submitted to Traveloka, will accordance with the Traveloka's Privacy Policy, including:
      1. Use of the TravelokaPay service
        1. User Name;
        2. Traveloka Profile Id;
        3. TravelokaPay Id;
        4. Email; and
        5. Mobile Phone Number.
      2. User Information which includes but is not limited to:
        1. Transactions conducted by User;
        2. User behavior in selecting products and services as well as other features on the Site;
        3. Information on User interests and preferences regarding the use of the Site;
        4. Information of User experience in using the Site;
        5. User track record (”log”) which includes but is not limited to internet protocol (“IP”) addresses, geographic location data, operating system type, nationality, search preferences, as well as other general data related to internet usage;
        6. Information on survey results provided by us;
        7. Information from third parties such as but not limited to Personal Data and/or Transaction Data information provided by Payment Service Provider partners, vendors, agents, professional advisors, consultants, and other parties that Traveloka collects in connection with the purpose of the involvement of third parties.
    3. By using the TravelokaPay, You agree that the collection, processing, uses, and submission of the data that you submit to us through the Site in, including Your personal information and/or other data submitted to Us is correct, accurate, and reasonable, must be subject to the privacy policy that applies at Traveloka.
    4. We may, at any time and for any reason, request additional information or documentation, including but not limited to confirmation of your identity, age and/or your bank details or debit, credit, prepaid facilities. You agree that you will promptly provide us with such information and/or documentation upon request. If you do not immediately provide such information and/or documentation, we may, limit the use of TravelokaPay or even suspend or stop Your use of TravelokaPay.
    5. You authorize Traveloka to ask any questions we deem necessary to validate and verify your identity and the information provided to us (either directly or through third parties) at any time and for any reason.
    6. You must immediately provide information to Traveloka for any changes to your personal information such as your name, email, mobile number, and other information.
    7. If there is a dispute between you and a third party in connection with your use of TravelokaPay, Traveloka has the right to suspend your usage of TravelokaPay until the dispute is fully resolved.
    8. Traveloka reserves the right to suspend, close, and/or terminate the TravelokaPay on the Site. Traveloka for a specified period of time for maintenance purposes, and other purposes deemed valid by Traveloka, with or with or without prior notice to You.
    9. Traveloka does not manage or control Our partners who provide payment services on the Site.
  2. TRAVELOKAPAY FEATURE
    1. UANGKU
      is an electronic money product issued and administered by PT Smartfren Telecom Tbk and licensed by Bank Indonesia. Traveloka collaborates with PT Smartfren Telecom Tbk in providing the UANGKU payment feature. User can register their UANGKU account on the Site, top up their balance, and purchase products available on Site using UANGKU as a means of payment.
    2. My Cards
      is a feature that allows User to add and save User credit/debit card details in the site so that there is no need to enter card information every time You make a transaction at Site.
    3. Instant Debit
      is one of the payment methods in TravelokaPay that provides offers to debit card owners to provide convenience for User, where user can register their debit cards in the Site so that user do not have to keep entering the card number every time they make a transaction.
  3. UANGKU TERMS
    1. You can register or activate a UANGKU account. In this case, Traveloka may request that you send your personal data to Traveloka, to be forwarded to Smartfren for UANGKU account registration purposes (if needed).
    2. You can use Your UANGKU account balance to make payment transactions on the Site.
    3. You can top up your UANGKU balance on TravelokaPay through the methods available on the Site and other methods provided by Smartfren (“Top-up Process”). By selecting a particular payment method provided by Smartfren thus You agree to the terms of service of other payment methods including fee that may be charged for Top Up Process.
    4. In the event of hindrance and/or loss incurred related Top Up Process due to the failure from Our partner Payment System Service Provider or other third party’s system shall not be Our responsibility. However, if we receive complaints from You regarding such issues, we may, based on our discretion, forward your complaints to such Payment System Service Provider Partner or the relevant third party for their follow up.
    5. You are fully responsible for every Top-up Process that You conduct, including but not limited to inputting the correct top-up amount and the correct bank account number. All losses related to the Top Up Process may occur from your fault, Your negligence, and/or any other factor in carrying out the Top-up Process are at your own risk and responsibility. You hereby indemnify and hold harmless Traveloka and Smartfren for any problems arising from your fault, Your negligence, and/or any other factor in the Top-up Process.
    6. Balance and transaction limits on UANGKU accounts are as follows:
      1. For Unregistered UANGKU account:
        1. The UANGKU account balance is limited to IDR 2,000,000 (two million rupiah).
        2. The transaction per month may not exceed IDR 20,000,000 (twenty million rupiah).
      2. For registered UANGKU account:
        1. The UANGKU account balance is limited to IDR 20,000,000 (twenty million rupiah).
        2. The transaction per month may not exceed IDR 40,000,000 (forty million rupiah).
    7. If the balance or monthly transaction of Your UANGKU exceeds such limits, We are entitled to conduct a verification and take any further action, including not processing Your transaction order.
    8. Your UANGKU account is not a savings account and is not included in the protection program by Lembaga Penjamin Simpanan. Therefore, You will not receive any interest on the value of your deposits in the UANGKU account. Traveloka or Smartfren are not bank therefore, Our services cannot be considered as banking services.
    9. The UANGKU payment feature is only available on the Traveloka Application with a minimum version of 2.20.
    10. We do not provide withdrawal or transfer features for Your UANGKU accounts.
    11. The payment refund for transactions using UANGKU balance will be returned to Your UANGKU account balance.
    12. The balance transaction history listed on the Site will be conclusive proof of the use of your UANGKU balance.
    13. By using UANGKU, you represent that you have read, understood, and agree to Terms and Conditions of UANGKU
  4. MY CARDS TERMS
    1. When choosing to make payments with My Cards, you must register a valid credit card or debit card, according to the instructions on the Site. You must use a credit or debit card that you have and issued in your name.
    2. You agree that We can verify and validate your card details when you first register the card and when you use My Cards to make payments. Any fees that you incur for transaction authorization that result in excessive withdrawals on Your account are not Traveloka's responsibility.
  5. INSTANT DEBIT TERMS
    1. When choosing to make payment with Instant Debit, You must register a valid telephone number that has been registered with your issuing Bank, in accordance with the instructions on the Site. You must use a debit card that you have and issued in your name.
    2. You agree that you must verify your registration and payment at the discretion of Your issuing Bank. Any fees you incur for registration authorization or transactions that result in excessive withdrawals on Your account are not Traveloka's responsibility.
  6. REJECTION OF TRANSACTION
      Traveloka reserves the right to suspend or limit or block the use of your credit/debit card if:
    1. Rejection from the Bank that issued Your card.
    2. Our system finds suspicious transaction patterns, including but are not limited to breach of these Terms and Conditions, Traveloka’s Terms and Conditions and/or violate the prevailing laws and regulations.
  7. REPRESENTATIONS AND WARRANTIES
    1. You guarantees that the money used for payment transaction using TravelokaPay does not come from and/or for the purpose of money laundering and/or financing terrorism activities.
    2. You has read and understand this Terms and Conditions of TravelokaPay in a complete, correct and clear manner and therefore You agree to bind itself to this Terms and Conditions of TravelokaPay and fully release of all claims You may have against the Traveloka and all relevant parties in association with Traveloka.
  8. LIMITATION OF LIABILITY
    1. We are not responsible for transaction failures due to disruptions to the bank system or payment system provider and including in the event of a dispute with the Bank.
    2. In the event of a fraud case or unauthorized use of your card by a third party, You must immediately contact your bank or card issuer. In such cases, Traveloka is not responsible for cases of fraud or unauthorized use of your card by third parties. Traveloka is not obligated to refund to You.
  9. TERMINATION OF SERVICE
    1. You can terminated of using TravelokaPay for the following reasons:
      1. A request by you to terminate the integration of UANGKU on traveloka Pay or delete your debit or credit card;
      2. Our policy accordance to the prevailing laws and regulations;
      3. A force majeure;
      4. Rejection of transaction.
    2. By discontinuing your use of TravelokaPay, You understand that all outstanding obligations to each card issuer are still obligatory for You to complete with each card issuer.
    3. By terminating the use of TravelokaPay, We can still store your personal data related to the use of TravelokaPay in accordance with the applicable laws and regulations.
    4. You can still use the TravelokaPay service again in accordance with TravelokaPay’s Terms and Conditions.
  10. CUSTOMER COMPLAINT SERVICE
    1. If you have a complaint related to TravelokaPay service, you must submit complaint to Traveloka Customer Service https://m.traveloka.com/id-id/cs or 0804-1500-308/(021)29103300 no later than 7 (seven) days after the transactions.
    2. You can also submit complaints to Bank Indonesia through the call center BI Talk 131; email: talk@bi.go.id accordance with Bank Indonesia's terms and conditions.
  11. GOVERNING LAW
    1. These Terms (and any and all disputes arising out of or in connection with these Terms (including any alleged breach or challenge to the validity or enforceability of these Terms)) shall be governed by and interpreted in accordance solely with the Laws of Republic of Indonesia.
    2. Any dispute arising out of or in connection with these Terms and Services, including any question regarding its existence, validity or termination, both parties shall first discuss in good faith to reach an amicable resolution within sixty (60) days from the date of the notice of dispute. However, if such dispute may not be settled by mutual consultation within sixty (60) days, it shall be referred to and finally resolved through arbitration in Badan Arbitrase Nasional Indonesia (BANI). The seat of the arbitration shall be in Indonesia.
